Ex-PCACC boss, Muhuyi Magaji, applies for review of bail conditions, Kano govt insists conditions not met
Former chairman of Kano State Public Complaint and Anti-Corruption Commission (PCACC), Muhuyi Magaji Rimingado, has applied to a Kano Magistrate’s Court to have part of his bail conditions reviewed.
Rimingado, who approached the court, presided by Chief Magistrate Aminu Gabari, on Thursday through his lawyers, wanted the court to change some of the sureties it specifically required.
Muhuyi was arraigned on Friday after he was arrested by the police in Abuja on Thursday for giving false information to Kano State House of Assembly.
Chief Magistrate, Aminu Gabari, granted the defendant bail in the sum of N500, 000, with two sureties that should include maternal or paternal relations of the defendant and the Chief Imam of Sharada or Ja’en Jumuat Mosque.
Gabari also directed the defendant to submit his travel documents to the court.
Nigerian Sketch reported that the suspended chairman could not gain his freedom on Friday even though he was able to meet the bail conditions because court officials deserted the court premises, but he was somehow released from prison on Saturday, according to an online news medium (read about his release here).
Nigerian Sketch was informed by a court source on Wednesday that Kano State government was furious about Rimingado’s release and approached the court on Thursday to demand for the record of his release.
According to the source, the prosecution came to the court with an application to see if his bail conditions were satisfied before he was released. The court said they have the right to demand to see the record, and asked them come for a copy on Thursday.
A close associate of the ex-chairman confided in our reporter that the state may have deliberately influenced the inclusion of the name of the Imam of Sharada Jumuat Mosque among the required sureties because “they knew they compel him no to come to the court. Mind you, I know him to be the Imam that carries out Tafseer at the Government House. The aim was to make sure the defendant did not gain his freedom throughout the duration of the Sallah holidays.”
Our court source said the suspended chairman came with the Chief Imam of Rimingado and somehow got his release, and now his lawyers are applying for a review while the prosecution is working on the assumption that bail conditions have not been satisfied.
The court adjourned to Monday to rule on the ex-chairman’s application.
