Kano court sends Muazu Magaji to prison in defamation case against Ganduje
Magistrate’s Court No 58 in Kano State on Monday ordered the remand of former commissioner for works and infrastructure in the state, Muazu Magaji, in Kano Correctional Centre.
Magaji was arraigned before Senior Magistrate, Aminu Gabari on four-counts bordering on criminal defamation against Governor Abdullahi Umar Ganduje, where he pleaded not guilty to the charges read to him.
Prosecution counsel, Wada Ahmed Wada, applied orally for adjournment to enable the prosecution present witnesses before the court.
Defence counsel, Ghazali Datti Ahmed, on his part, moved a bail application for his client, citing Sections 35 and 36 of the 1999 Constitution, and referring to the health condition of the defendant, but the prosecution argued that Magaji did not provide evidence to support his acclaimed health challenge, urging the court to deny the bail application because the offence was grave.
The Magistrate denied the defendant’s bail application and ordered the he be remanded in the state correctional centre till February 3, 2022 when the case will resume for hearing.
Recall that Magaji was arrested in Abuja on Thursday, flown to Kano and brought to court on Friday but he could not be arraigned on Friday because he was not in good shape.
The criminal charge against him was hinged on an image he allegedly posted on Facebook which the nominal complainer claimed was capable of portraying Ganduje as an immoral and ungodly man.
